If you are convicted, you are going to jail. If this is your first offense within the last seven years, the mandatory jail requirement is one to two days.
If, however, this is your second offense within the last seven years, you are looking at a mandatory minimum of thirty to forty-five days in jail. A lot also depends on the specific facts of your case, and, believe it or not, in which county or city you were arrested. Every county and city has their own general guidelines for how they treat certain types of cases, especially as it relates to other factors such as your alleged BAC level, whether or not there was an accident, as well as whether or not you were cooperative and respectful on the night you were arrested.
Washington's Drunk Driving Laws are harsh.
