We will fight to keep you out of jail and able to legally drive.
If you have been arrested for DUI (Drunk Driving) in Lakewood, WA, you are probably feeling frustrated and a bit angry. You are also likely a bit confused and anxious. These emotions and feelings are completely understandable and very normal. Our Washington State DUI attorneys are here to help.
No one sets out to get arrested for Driving Under the Influence of Intoxicants and have their entire world turned upside with stress and anxiety. But we understand that life happens sometimes. Good people end up in bad situations for a variety of reasons.
One of the first questions that we are often asked by our clients is whether or not they are going to go to jail. Unfortunately, if you are convicted of Drunk Driving in Lakewood or anywhere else in Washington State, you will be required to serve time in jail. There is no way around. Judge's have absolutely no discretion on this issue.
If you are convicted, you are going to jail. The amount of jail, however, depends primarily on whether or not this is your first DUI, and, if this is not your first drunk driving charge, whether or not the prior offense occurred within the last seven years. If this is your first offense within the last seven years, the mandatory jail requirement is one to two days.
If, however, this is your second offense within the last seven years, you are looking at a mandatory minimum of thirty to forty-five days in jail. A lot also depends on the specific facts of your case, and, believe it or not, in which county or city you were arrested. Every county and city has their own general guidelines for how they treat certain types of cases, especially as it relates to other factors such as your alleged BAC level, whether or not there was an accident, as well as whether or not you were cooperative and respectful on the night you were arrested.
Washington's Drunk Driving Laws are harsh.
Even if this is your first offense, if you are convicted of a charge of Driving Under the Influence of Intoxicants here in Lakewood, you will at a minimum be sentenced to the following:
1. Mandatory Jail
2. Mandatory License Suspension
3. Mandatory Alcohol Evaluation & Follow Up Treatment
4. Mandatory Ignition Interlock Device
5. Mandatory Attendance at Victim Impact Panel
6. Mandatory SR-22 Insurance to Reinstate Your Driving Privileges
7. Mandatory Fines, Costs and Assessments
